The 250-gram threshold

Drones under that weight are exempt from registration for purely recreational flying, but the exemption disappears the moment the drone is used for any commercial purpose, including monetized content — the FAA has been explicit that posting drone footage to a monetized social media account counts as commercial use requiring registration and a Part 107 certificate, regardless of the drone's weight. Registration currently costs a small fee and is valid for three years.
Remote ID is now fully enforced, not optional
Remote ID requires a registered drone to continuously broadcast identifying information — essentially a digital license plate — including its location, altitude, and the operator's takeoff location, readable by other apps and by authorities. Enforcement of this requirement became fully active in 2024, meaning it's a genuine, active legal requirement in 2026, not a rule still being phased in. Many newer consumer drones have this built in; older models may need a separate add-on broadcast module to comply.
Recreational vs. commercial flying are legally different categories
Purely recreational flying — for personal enjoyment, with no commercial purpose — has its own simpler set of rules, including a required (but free) knowledge test. Flying for any commercial purpose, including real estate photography, paid inspection work, or monetized content, requires a Part 107 remote pilot certificate, a genuinely more involved process than recreational registration. It's worth being honest with yourself about which category actually applies before assuming recreational rules cover an intended use.
What actually matters for choosing a drone (once legally compliant)
Beyond the legal requirements, flight time, camera quality, obstacle avoidance sensors, and range are the practical differentiators between drones at different price points — flight time in particular is often shorter in real-world use than the advertised figure, since that number is usually measured under ideal, calm conditions rather than realistic outdoor use with wind and maneuvering.
